By purchasing or using a Solius Membership, you agree to the following terms and conditions, which supplement and form a part of the Solius Terms of Service. Capitalized terms not defined here have the meaning given to them in the Solius Terms of Service.
A Solius "Member" is any individual with an active Solius membership who accesses the Solius Services via their Solius account credentials for personal, non-commercial use. A Solius "Membership Holder" is the individual who activates and pays the subscription fees for a Solius Membership, or who holds an active Founding Membership. A Solius "Membership" is either a Solius Home Membership or a Solius Founding Membership, each as defined below.
Membership Types
Solius Home Membership. A Solius "Home Membership" may be purchased in connection with a Solius UVB light therapy device and provides the Membership Holder and members of their household at one residential address (up to 8 Authorized Users) with full access to the Solius Services on the same single registered device, for as long as the Home Membership remains active. A Home Membership is available on a monthly or annual basis. Home Membership pricing is available at www.solius.com/membership and within the Solius App.
An active Home Membership is required to unlock and use a Solius device. Once a Home Membership is activated and applied to a device, any Authorized User added to that device may use it for as long as the Membership remains active — Authorized Users do not need to hold their own individual memberships.
Solius Founding Membership. A Solius "Founding Membership" is a promotional membership offered to eligible early purchasers of a Solius device. A Founding Membership provides the Membership Holder and members of their household at one residential address (up to 8 user profiles) with full access to the Solius Services on the same single registered device at no recurring charge, for as long as the Founding Membership remains active. A Founding Membership remains active for the lesser of: (a) the service life of the registered device, or (b) ten (10) years from the date the Founding Membership is activated.
A Founding Membership is tied to the specific device serial number at the time of activation. It does not transfer to a new device, a replacement device, or any other person. At the end of the Founding Membership term, the Membership Holder will need to purchase a standard Home Membership to continue using the Services.
Each of the Solius Membership types is sold or issued separately. The Membership Holder is responsible for all activity associated with their Membership. Access to the Solius Services for any Membership type is contingent on the Member logging in using their Solius account credentials.
Device Users
A Home Membership or Founding Membership supports up to eight (8) Authorized Users on a single Solius device. All registered users must be household members residing at the same address as the Membership Holder and must meet the eligibility requirements set forth in the Solius Terms of Service.
Each Authorized User must have their own individual Solius account. The Membership Holder is responsible for ensuring that all users added to their device meet eligibility requirements and comply with these Membership Terms and the Solius Terms of Service.
If an Authorized User is removed from a device, that user may not be re-added to the same device for a period of thirty (30) days following removal.
Solius Memberships are for personal, non-commercial household use only. Memberships may not be used in connection with any business, clinic, studio, wellness center, workplace, or other commercial or quasi-commercial setting.
Account Registration
You can register for a Membership by completing the device setup process in the Solius App. You may also register by creating an account at www.solius.com or within the Solius App. All information you provide must be accurate, including your name, address, and any payment information. You are responsible for keeping your information up to date.
Promptly notify us or our payment processors if your payment method is canceled or if you become aware of unauthorized access to your account.
Billing Cycles and Auto-Renewal
Your Membership term and billing cycle begin on the date you activate your Membership and connect it to a Solius device, not on the date of purchase. If you purchase a Membership but do not activate it and connect it to a device, your billing cycle will not begin until activation and device connection are complete.
Monthly and Annual Home Memberships renew automatically on a monthly or annual basis, as applicable, from the activation date, until canceled in accordance with these terms. Billing occurs at the beginning of each Membership cycle. By purchasing a Home Membership, you acknowledge that it has recurring payment features and accept responsibility for all recurring charges.
Founding Memberships have no recurring billing. They remain active as described in the Membership Types section above.
Prepaid and Promotional Memberships. Solius may offer prepaid periods or promotional Memberships from time to time. Please read the details of those offers carefully, as any additional terms presented at signup will form part of these Membership Terms. Unless otherwise specified in writing, prepaid and promotional Memberships are non-refundable.
Activation Codes
Solius may issue Membership activation codes (for example, in connection with a device purchase or promotional offer). Activation codes have no cash value. Activation codes cannot be purchased, sold, transferred, assigned, redeemed for cash or credit, or used to pay debts. Activation codes may not be assigned or transferred to any third party and cannot be transferred by operation of law (such as by inheritance, in bankruptcy, or in connection with a divorce). Activation codes are available only to the designated recipient and are subject to these Membership Terms. Solius will resolve disputes as to the rightful owner of an activation code in its sole and absolute discretion.
Termination or Cancellation of Membership
Cancellation by Member. You may cancel your Home Membership at any time, but your cancellation will not be effective until the end of the then-current term (i.e. end of the month for monthly memberships or end of the annual term for annual memberships). If you cancel, your Membership will remain active until the end of the then-current paid period, and your Membership will not renew after that period expires. We will not provide a prorated refund for the remaining portion of any paid period.
To cancel, use the account management settings in the platform through which you purchased your Membership (Apple App Store, Google Play, or Shopify/Recharge), or contact us at hello@solius.com.
Device Reset. A Device Reset disconnects your Solius account from a specific device serial number. A Device Reset is not the same as canceling your Membership subscription. In order to cancel your Membership, you must do so through the applicable platform settings or by contacting us at hello@solius.com. To perform a Device Reset, use the settings in your Solius App profile. Double confirmation is required before any Device Reset is processed. If you are unable to connect to your device via Bluetooth to perform a reset, contact Solius Customer Support for assistance.
Suspension or Termination by Solius. Solius may immediately terminate or suspend your Membership or access to the Services without notice if:
your payment is overdue (we will use reasonable efforts to notify you before we terminate or suspend);
you provide false or inaccurate information;
you violate these Membership Terms, the Solius Terms of Service, or any other applicable Solius policy; or
you engage in conduct that is threatening, abusive, or harassing toward Solius employees, agents, or other users.
If your Membership is terminated for any of these reasons, Solius has the right to delete the data associated with your account and terminate access to the device for all Authorized Users, and you will not be provided a prorated refund of your paid Membership fees.
Failed Payment. If a membership payment fails, your Membership will be frozen — therapy access will be suspended for all Authorized Users — rather than immediately canceled. If payment is not resolved within thirty (30) days, your Membership may be terminated. You will be notified of failed payments and given the opportunity to update your payment method.
Payment
Membership Holders agree to pay the fees specified at the time of purchase (plus any applicable taxes). Fees are subject to change with notice as described in the Terms of Service. Membership may be purchased through the Apple App Store, Google Play, or Shopify/Recharge. App Store and Google Play purchases are subject to those platforms' billing terms and conditions.
You authorize us to charge your payment method on a recurring basis in accordance with your selected billing cycle. If you provide a debit card instead of a credit card, you authorize all charges to be applied to that debit card unless and until you provide a credit card number for billing purposes.
If you believe you have been billed in error, please contact us at hello@solius.com within 60 days of the billing date.
Non-Transferability of Memberships
Solius Memberships — including Founding Memberships, Home Memberships, and any activation codes — are personal to the Membership Holder and are non-transferable. A Membership may not be transferred to another person or another device. Solius does not honor ownership transfer of Memberships.
Modification of Terms
We may update these Membership Terms at any time. If we do so, we will notify you by posting updated terms on the Solius Site and/or through the Solius Services, and we will update the "Last Updated" date above. If we make material changes, we will provide additional notice, such as by email. Your continued use of the Services after updated terms are posted confirms your acceptance of those changes.
For Founding Members, any modification to these Membership Terms will not alter the core benefit of the Founding Membership — no-charge access for the lesser of the device service life or ten (10) years — without your express consent.
